Giveaway terms and conditions – APAC

Avnet & Infineon Power Campaign (“Event”)

1. This Avnet & Infineon Power (“Giveaway”) is run by Avnet Asia Pte Ltd (hereinafter referred to as the Organiser; Infineon is the Sponsor) on the following terms and conditions (the “T&Cs”).

2. By participating in this Giveaway, all participants (“Participants”) will be deemed to have read, accepted, and agreed to be bound by these T&C’s. Participants are advised to review these T&Cs before entering the Giveaway and print and keep safe a copy of the T&C’s. The Organiser reserves the right to revise the T&C’s from time to time. Revised T&C’s will be posted here: [Avnet & Infineon Power Campaign]  In case no communication of withdrawal is received from the Participants, it shall be treated as deemed acceptance on the part of Participant and the Participant shall be bound by the amended T&C’s.

3. Any Participant (subject to the T&C’s) from the following region: ASEAN & India only, may enter this Giveaway. Participant not meeting all the requirements set out in the T&Cs are excluded from entry.

4. There will be a total of 20 Participation Prizes awarded for this Giveaway with a limit of 1 Participation Prize for each country, i.e., 1 winner per country. Participation Prizes will be awarded on a first come first serve basis (it will be awarded to the 1st registrant from each country who has answered the quiz correctly until 20 Participation Prizes have been awarded). In the event that the 20 Participation Prizes cannot be awarded to Participants from different countries due to a lack of Participants from any country, the Organiser reserves the right to award the Participation Prize to an alternative Participant alternative from a repeated country.

5. The Giveaway runs from 31 August 2022 to 30 September 2022 (TBC). The Participants who have visited the campaign landing page, completed the quiz correctly and filled up personal info completely shall be entitled to win a USD$25 Amazon eGift Card set out in Clause 14 below, subject to the following requirements.

For purposes of determining eligibility, the owner of any email used to enter the Giveaway will be determined by who is the authorized account holder of the email address at the time the registration form is received by the Organiser. The authorized account holder is the natural person who is assigned to the email address by an Internet Service Provider or other organization(s) that is responsible for assigning email addresses or the domain names associated with email addresses.

7. The Participants who are entitled to the Participation Prize will be notified by email by 20 October 2022.  The Organiser’s decision is final, and no further correspondence will be entered into.

8. All participants of the Event are Eligible Participants, excluding the following:

a) Duplicate and multiple registration by the same Participant (determined by email); and

b) Participants applying from countries/areas that are not eligible for the Event or Giveaway (see above, Clause 3 of this document)

9. No Purchase is necessary or required to enter the Giveaway. The Participant agrees that the Organiser is not selling and/ or promoting any good or service and is also not inducing the Participant to purchase/ buy any goods or services.    

10. The Organiser will not be responsible in any way for entries which are not received for any reason, including technical error.

11. Participants must be aged 18 or over.

12. Employees from public sector companies or officials are excluded from participation.     

13. Employees of the Organiser or any of its affiliate companies, subsidiaries, advertising and promotion agencies, and their family or household members, are not eligible to participate.

15. The Participation Prizes are non-transferable, with no cash redemption or equivalent. The Organiser reserves the right to substitute all prizes with a suitable equivalent and the provision of the gift may be delayed or a substitute provided, subject to prior notice and approval of the local authorities (where applicable).

16. To claim the prize, the Participant must confirm receipt of the email within 14 days of notification by the Organiser. If the Participant does not respond in that time period, they will be deemed to have waived entitlement to their prize. All eligible Participants should receive their Participation Prizes within 28 days after confirming their shipment address. Failure to timely or properly claim any Participation Prize will result in forfeiture. By accepting a Participation Prize, the Participant consents to the use of their name and/or likeness for all legitimate business purposes including advertising and promotional activities, without additional compensation, unless prohibited by law.

17. The Organiser reserves the right to verify the eligibility of any Participant before a Participating Prize is issued and may require proof of identification and age. If the Organiser suspects fraud or misconduct, or if it is discovered that a Participant has failed to comply with the eligibility requirements set out in these T&Cs, then the Participation Prize may be withheld or withdrawn.

18. Any unclaimed Participation Prize may be awarded to a new Participant next in line.

19. The Organiser reserves the right to withdraw or amend the Giveaway or extend the period of participation in its sole discretion. The Organiser will not be liable for any such withdrawal or change to the Giveaway.

20. Each Participant receiving a Participation Prize agrees to be responsible for all applicable taxes, duties, or other charges payable in relation to the Participation Prize.

21. A Participant may not enter the Giveaway if, by entering into it might cause the Organiser and/or the Participant to be in breach of any agreement (including but not limited to any contract of employment) to which Participant is a party or in breach of any law, regulation or rule having the force of law to which the Participant or the Organiser may be subject. The Organiser reserves the right to disqualify any entry made in breach of this condition.

22. By participating in the promotion, participants agree that their personal data (like business contact information, project related data) to be collected, used, and processed by the Organiser. Participants acknowledge and further consent that his personal data may be shared with and processed by Infineon Technologies Asia Pacific Pte Ltd (“Infineon”) and its licensed distributors & partners for direct interaction using email and phone. The Organiser and Infineon take the Participants’ privacy seriously and undertake to comply with the relevant data protection legislation. Participants can revoke their consent any time. by writing to the Organiser through email address in below Clause 25. Save as otherwise, the personal information received as a result of this Giveaway will not be sold to third parties and will be used solely for the purposes of this Giveaway, for Organiser’s own customer research, business development and statistical purposes and to promote to the Organiser’s business services and products via email where you have consented to Organiser doing so. Participants shall agree on and accept the privacy and data protection policy of the Organiser & Infineon in connection with his/her information provided before he/she participates in the Giveaway. By participating in the promotion, Participants agree that they have read, agreed and accepted the aforementioned privacy and data protection policy of the Organiser & Infineon. Each Participant receiving a Participation Prize agrees that he must allow details regarding the winning of the prize to be published in order to claim the prize.

23. By participating in this Giveaway, Participants agree to release and hold harmless the Organiser, their advertising and promotions agencies and each of their respective parent companies, affiliates, subsidiaries, officers, directors, agents and employees, from any and all liability whatsoever for any injuries, losses, or damages of any kind arising from or in connection with (1) awarding, acceptance, receipt, possession, use and/or misuse of any Participation Prize awarded herein; or (2) participation in the Giveaway or any Participation Prize-related activities. The Organiser does not exclude liability under the T&Cs for death, personal injury arising or damage to property from its negligence, or for any matter in relation to which it would be illegal for the Organiser to exclude or attempt to exclude our liability.

24. Any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of Singapore and Participant irrevocably agrees that the courts of Singapore shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Giveaway.
